My cousin was in graduate school at Vanderbilt when he received his draft notice, and he was given the option of signing up on his own with the advantage of choice - his choice was to go to officers training.  

Since my cousin served in the military as did, Dr. Ron Paul, neither can be considered a draft dodger in any sense (not since) of the word.</description>

		<description>It sounds to me like you are trying to make something out of nothing.  This is a man who stands up for OUR constitution NO MATTER WHAT.  The fact that you are badgering and trying to make something out of him being drafted is naive and just plain embarrassing.  As a 8 year veteran of the U.S. Marine Corps. And my life on the line... I can assure you that this is the only presidential candidate that means what he says, and practices what he preaches.  I&#039;ve done two tours in Iraq, and one in Afghanistan while in the marines - I can assure you, all my fellow soldiers want Dr. Ron Paul as their true commander and chief.  I&#039;ve had friends that have died in my arms because of this &quot;undeclared&quot; war. I can assure you that the words written in that constitution are there for a reason. 		<description>At a suppresssion hearing, the exact moment when a warrantless arrest occurred is frequently the most important preliminary determination for a court. The legality of a warrantless arrest hinges, in large measure, on the probable cause or guilt-laden facts confronting the police officer up to and including, but NEVER after, the actual moment of arrest. At the moment of arrest, probable cause CEASES TO BUILD. Any after-the-arrest, guilt laden facts that develop will not be considered by the courts as part of the probable case necessary to justify the arrest. (The Law of Arrest, Search and Seizure, 3rd Edition Creamer). 

For purposes of the 4th amendment, Zimmerman was UNDER ARREST, the moment the police hancuffed him and took him to the police station. If they had handcuffed him and remained at the scene, perhaps the courts could conclude that he was being temporarily detained, considering the seriousness of the incident involving a weapon and a deceased individual.  Zimmerman was handcuffed, placed in a patrol car and driven to a police station.  I don&#039;t know how long he was in custody before he was released, but he was not free to leave while in police custody.  I&#039;m a retired police sergeant and not an attorney; however,  this would be my argument.  I would focus on the time of arrest to argue lack of probable cause.  Any guilt laden facts and evidence obtained after the fact (arrest) would not be admissible (Fruits of the poisonous tree).</description>
